Our Policy

Service Agreement

This Service Agreement (the "Agreement") is made and entered into by and between Shadowlightroom ("Provider") and the client ("Client") for the purpose of setting forth the terms and conditions under which the Provider will provide real estate photography services to Client.

Payment Policy:

Client agrees to pay Provider the total amount due for the services booked in advance to confirm the booking. If Client fails to make payment in advance of the photoshoot, Provider reserves the right to cancel the photoshoot and retain any payments already made by Client as liquidated damages. Upon receipt of payment, Provider will deliver the final photos and floor plans to the Client within 24 hours of the photoshoot, and the video within 48 hours.

Scope of Services:

The provider will provide real estate photography services to the Client, including the delivery of completed images, floor plans, and video within 24 hours of the photoshoot (the "Services"). The delivery of the video may take up to 48 hours. The specific Services to be provided will be determined based on the Client's booking.

Intellectual Property:

Provider retains the copyright to all media produced during the photoshoot. The client is granted a limited, non-exclusive license to use the images for the purpose of marketing the property being photographed. The client may not sell, distribute, or use the images for any other purpose without the written consent of the Provider.

Model Releases:

If any individuals are photographed as part of the real estate photoshoot, the Client agrees to obtain a model release from each individual and provide copies to the Provider upon request.

Limitation of Liability:

The provider will not be liable for any accidents, injuries, or damages that may occur during the photoshoot. The client assumes all responsibility for the safety of individuals and the condition of the property during the photoshoot.

Indemnification:

Client agrees to indemnify and hold Provider harmless from any claims or damages arising from the use of the images.

Cancellation Policy:

If Client cancels the photoshoot more than 24 hours before the scheduled date, Provider will refund any payments made by Client in full. Otherwise, the shoot can be rescheduled at no extra cost. If the Client cancels or reschedules the photoshoot less than 24 hours before the scheduled date, the Client will be responsible for paying Provider a cancellation fee of $50.

In the event that Provider needs to cancel the photoshoot due to unforeseen circumstances, Provider will refund any payments made by Client in full and will make every effort to reschedule the photoshoot at a mutually convenient time.

No-Show Policy:

If the Client does not show up or provide access to the property for the scheduled photoshoot within 30 minutes of the scheduled start time and does not provide at least 2 hours’ notice, the Client will be responsible for paying Provider a no-show fee of $100.

Travel Policy:

If the photoshoot location is more than 20 KM from Provider's studio in Richmond, the Client agrees to pay a travel fee to cover the cost of transportation. This fee will be added to the total amount due for Services rendered, as outlined in the Service Agreement. The client also agrees to provide the Provider with a safe and secure place to stay during the photoshoot, if necessary.

Reshoot Policy:

The provider will make every effort to deliver high-quality media to the Client. However, if the Client is not satisfied with the finished work and requests a reshoot, the Client agrees to pay an additional fee of 50% of the original order, or a minimum of $150 to cover the cost of the reshoot and edits. The client must notify the Provider of any dissatisfaction with the images within 15 days of receipt. The provider will not be responsible for any dissatisfaction with the images reported after this time period.

Shoot Time Policy:

The photoshoot is scheduled to last between one and one-half hours, including setup and breakdown. If Client requests additional time, Client agrees to pay an additional fee of $50 per half hour.

Price Change Policy:

Provider reserves the right to change the prices for the Services at any time and without notice. Any changes to the prices will be reflected on the Provider's website and will become effective immediately. The client will be responsible for paying the updated prices for any Services booked after the date of the price change. If the Client has already paid for Services that are affected by a price change, the Provider will honor the original price for those Services.

Confidentiality Policy:

Both parties agree to keep the details of this Agreement and any confidential information exchanged during the course of the project strictly confidential.

Force Majeure Clause:

Neither party will be held responsible for any failure to perform under this Agreement due to unforeseen circumstances beyond its control, including but not limited to acts of God, war, strikes, or natural disasters.

Dispute Resolution Clause:

Any disputes arising under this Agreement will be resolved through mediation or arbitration, as agreed upon by the parties.

Governing Law Clause:

This Agreement will be governed by and construed in accordance with the laws of the State of [State], and any legal action arising out of or in connection with this Agreement will be brought in the courts of [State].

Limitation of Damages Clause:

In no event will either party be liable to the other for any indirect, consequential, punitive, or special damages arising out of or in connection with this Agreement.
